The conditions making a trademark 'registerable' :

  • The trademark must be lawful. Certain signs can not be used, the signs of a trademark can not be against general morals or against the public order.
  • The sign must not be misleading. The trademark must not be deceptive with respect to the product which it represents. It must not introduce any error as to the origin of the product / service nor as to its characteristics.
  • The sign must be distinctive. It must not be a normally used reference of a product for example. A trademark for a perfume can not, for example, be registered as the trademark 'Perfume'.
  • The trademark must be available, that is to say that the trademark must not already have been registered in any form.
